These Terms of Service ("Terms") govern your access to and use of Nurtch (the "Service"). By signing up or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. The Service
Nurtch is an AI-powered follow-up tool for real estate professionals. It drafts personalized emails and SMS messages on your behalf, sends them through your connected email account, detects replies, and helps you stay in touch with your sphere.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you're using Nurtch on behalf of a brokerage or organization, you represent that you have the authority to bind that organization to these Terms.
3. Your account
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access. We are not liable for any loss resulting from your failure to safeguard your account.
4. Acceptable use
You agree not to:
- Send spam, deceptive, or unsolicited bulk messages through the Service.
- Send messages to people who have not consented to hear from you, or who have opted out.
- Violate the CAN-SPAM Act, TCPA, GDPR, CASL, or any other applicable communications laws.
- Impersonate others, harass, threaten, or send harmful content.
- Use the Service to compete with Nurtch or to build a competing product.
- Reverse-engineer, scrape, or attempt to circumvent rate limits or security controls.
- Misuse the AI to generate content for fraud, deception, or unlawful purposes.
Compliance with messaging laws — including obtaining consent from recipients and honoring opt-outs — is your responsibility. Nurtch helps detect opt-outs but you remain the sender of record for all messages sent through the Service.
5. AI-generated content
Nurtch uses third-party AI models to draft messages. AI output can be inaccurate, outdated, or off-tone. You are responsible for reviewing every message before it's sent — even when you use auto-send mode. We make no warranty about the accuracy or appropriateness of AI-drafted content.
6. Subscription & billing
Nurtch offers a 14-day free trial. After the trial, the Pro plan is $197/month, billed in advance and recurring monthly until cancelled. You can cancel anytime from the billing settings; you will retain access until the end of the current billing period.
We do not offer refunds for partial months. If we materially change the price, we will notify you at least 30 days before the change takes effect; you can cancel before then to avoid the new rate.
7. Cancellation & deletion
You can cancel your subscription anytime. Cancelling stops billing but keeps your data accessible until the end of the period. To delete your account and all associated data, email us at hello@nurtch.ai. Deletion is permanent and cannot be undone.
8. Intellectual property
Nurtch and its underlying software, design, and brand are owned by us. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing.
Your contacts, message content, and voice profile remain yours. By using the Service, you grant us a non-exclusive, royalty-free license to process this data solely for the purpose of operating the Service for you.
9. Third-party services
The Service depends on third-party providers (Supabase, Vercel, Anthropic, Stripe, Google, Microsoft, Resend). Outages or changes by these providers may affect availability. We are not responsible for losses arising from third-party service interruptions, but we will work in good faith to restore service quickly.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-drafted content will meet your expectations.
11. Limitation of liability
To the maximum extent permitted by law, Nurtch and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business arising out of or related to your use of the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold Nurtch harmless from any claim, demand, or damages arising from your messages, your contacts, your use of the Service in violation of these Terms, or your violation of any third-party rights or applicable law.
13. Termination
We may suspend or terminate your account if you violate these Terms, abuse the Service, fail to pay, or use the Service in a way we reasonably believe poses risk. We will provide notice when feasible.
14. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida.
15. Changes to these Terms
We may update these Terms from time to time. If changes are material, we'll notify active users by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
